Terms of Service
Last updated: March 2025. Please review these terms carefully. By using Ember, you agree to be bound by them.
1. Acceptance
By creating an account, accessing, or using Ember ("the Service"), you agree to these Terms of Service, our Privacy Policy, and our Community Guidelines. If you do not agree, you may not use the Service. We may update these terms from time to time; we will notify you of material changes via email or in-app notice.
2. Description of Service
Ember is a creator economy platform that enables fans to support creators through tips, gifts, messages, subscriptions, digital content, and bookable services. Creators publish content, offer services, and earn Embers. Merchants may offer products and services through the platform.
3. Embers Currency
Embers are in-app credits. Red Embers are purchased with real currency and used to support creators. Blue Embers are earned by creators when fans support them. Embers have no cash value outside the platform, are non-refundable except as required by applicable law, and cannot be transferred or resold.
4. Account Eligibility
You must be at least 18 years old and legally able to enter into binding contracts. You represent that you meet these requirements. You are responsible for maintaining the security of your account, for all activity under it, and for providing accurate information. We may require identity verification.
5. Community Guidelines & Prohibited Content
You may not post content that is illegal, harmful, harassing, fraudulent, infringes others' rights, or violates our Community Guidelines. This includes but is not limited to: content exploiting minors, promoting violence, impersonation, spam, or content that violates intellectual property rights. We reserve the right to remove content and suspend or terminate accounts that violate these terms.
6. Creator & Merchant Obligations
Creators and merchants are responsible for their content, compliance with applicable laws (including tax obligations), and their relationship with fans or customers. Earnings are subject to applicable tax reporting. Withdrawals are governed by our withdrawal policy, including fees and minimum thresholds.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE UNINTERRUPTED ACCESS. CONTENT FROM CREATORS AND MERCHANTS IS NOT ENDORSED BY US.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMBER AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM OR ONE HUNDRED UNITED STATES DOLLARS.
9. Indemnification
You agree to indemnify and hold harmless Ember and its affiliates from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these terms.
10. Governing Law
These terms are governed by the laws of the Republic of the Philippines, without regard to conflict of law principles. Disputes shall be resolved in the courts of the Philippines.
